KJD Law Firm Advises PT Petrokimia Gresik on Labour Crisis

PT Petrokimia Gresik, one of the subsidiaries of PT Pupuk Indonesia (Persero), is an agrichemical industry, produces various kinds of fertilizer and becomes strategic industry to support government programmes in increasing agricultural product and food security. PT Petrokimia Gresik was state owned company, established in 1972 as public services company (perusahaan umum) then converted as limited liability company (perseroan terbatas) in 1975. The Indonesian government restructuring programme on state owned companies in 2011 then establishing PT Pupuk Indonesia (Persero) as a holding company for seven state owned companies in agrichemical industry, in which PT Petrokimia Gresik to be one of the subsidiaries.

With more than 3,000 workers, PT Petrokimia has maintained its long reputation on good and harmony industrial relation by complying the regulation on the workes’ rights. PT Petrokimia Gresik has a commitment to increase its workers welfare by increasing their wages gradually until reaching an optimum amount in 2016. Unfortunately, the workers – through labour union – insist that it should be realized in July 2015, otherwise they will strike as a form of protest. Then, PT Petrokimia Gresik asked KJD Law Firm to advise the company on this matter. KJD Law Firm advises the company to acknowledge and respect the rights of the workers to strike, as long as it is conducted in accordance to the prevailing regulation. Any unnecessary steps or action taken by the company, such as suppressing or threaten against the workers, should be avoided. The firm, by its advocates, also represents the company in negotiation as well as mediation with labours union.
